Terms of Service

These Terms of Service ("Terms") govern your access to and use of Pagesmith ("we", "us", or "our"), an AI-powered website building service available at pagesmith.ai (the "Service"). By using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you:

  • Are at least 18 years old or the age of majority in your jurisdiction
  • Have the legal capacity to enter into a binding agreement
  • Accept these Terms and our Privacy Policy
  • Will comply with all applicable laws and regulations

If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Service Description

Pagesmith is an AI-powered platform that enables you to:

  • Create websites using natural language instructions and AI-generated content
  • Edit and customize website content, design, and functionality
  • Host and publish websites on our infrastructure
  • Connect custom domains to your websites
  • Integrate third-party services (analytics, social media, etc.)
  • Export your website code

We continuously improve the Service and may add, modify, or remove features at our discretion.

3. Account Registration

3.1 Account Creation

To use the Service, you must create an account with accurate, current, and complete information. You may register using email/password or third-party authentication providers (Google, etc.).

3.2 Account Security

You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized access

We are not liable for any loss or damage arising from unauthorized account access due to your failure to protect your credentials.

3.3 Account Restrictions

You may not:

  • Create multiple accounts to abuse free tiers or promotions
  • Share account access with unauthorized parties
  • Transfer your account without our written consent
  • Use automated means to create accounts

4. AI-Generated Content

4.1 How It Works

Pagesmith uses artificial intelligence to generate website content based on your instructions. The AI creates text, suggests layouts, and writes code to build your website.

4.2 Your Responsibility

While AI assists in content creation, you are solely responsible for reviewing, editing, and approving all content before publishing. You must ensure that:

  • Content is accurate and not misleading
  • Content does not infringe third-party rights
  • Content complies with applicable laws
  • Content meets your quality standards

4.3 No Guarantees

AI-generated content is provided "as is." We do not guarantee that AI content will be:

  • Accurate, complete, or error-free
  • Suitable for any particular purpose
  • Free from bias or inappropriate content
  • Original or non-infringing

You should independently verify any facts, claims, or information in AI-generated content, especially for legal, medical, financial, or other critical applications.

5. Acceptable Use Policy

You agree not to use the Service to create, host, or distribute:

5.1 Prohibited Content

  • Illegal Content: Anything that violates applicable laws or promotes illegal activities
  • Harmful Content: Malware, phishing, scams, or deceptive schemes
  • Hateful Content: Content that promotes discrimination, harassment, or violence against individuals or groups
  • Adult Content: Pornography or sexually explicit material
  • Violent Content: Gore, graphic violence, or content promoting self-harm
  • Infringing Content: Material that violates copyrights, trademarks, or other intellectual property rights
  • Misleading Content: Fake news, misinformation, or impersonation
  • Spam: Unsolicited bulk communications or SEO manipulation

5.2 Prohibited Activities

  • Attempting to access, tamper with, or use non-public areas of the Service
  • Probing, scanning, or testing the vulnerability of any system
  • Circumventing any security or authentication measures
  • Interfering with or disrupting the Service or servers
  • Using the Service to send spam or unsolicited communications
  • Scraping or extracting data from the Service without permission
  • Reselling or redistributing the Service without authorization

5.3 Enforcement

We may, at our sole discretion, investigate violations and take appropriate action, including:

  • Removing or disabling access to content
  • Suspending or terminating your account
  • Reporting violations to law enforcement
  • Taking legal action

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you create, upload, or generate using the Service ("Your Content"). By using the Service, you grant us a limited license to:

  • Host, store, and display Your Content to operate the Service
  • Create backups for data protection
  • Modify Your Content as necessary for technical compatibility

This license terminates when you delete Your Content or your account.

6.2 Our Service

We own all rights to the Service, including:

  • The Pagesmith platform, software, and technology
  • Our branding, logos, and trademarks
  • Templates, components, and pre-built assets (unless otherwise specified)
  • Documentation and marketing materials

You may not copy, modify, distribute, or reverse engineer any part of our Service without explicit permission.

6.3 Code Export

You may export the generated code for your websites. Exported code is yours to use, modify, and host elsewhere. However, some components may include third-party libraries with their own licenses.

6.4 Feedback

If you provide suggestions, ideas, or feedback about the Service, you grant us a perpetual, royalty-free license to use and incorporate such feedback without obligation to you.

7. Pricing and Payment

7.1 Free Tier

We offer a free tier with limited features. Free accounts may have restrictions on storage, bandwidth, custom domains, or other features as specified on our pricing page.

7.2 Paid Subscriptions

Paid plans provide additional features and resources. By subscribing, you agree to:

  • Pay the fees displayed at the time of purchase
  • Provide accurate billing information
  • Authorize recurring charges for subscription plans

7.3 Billing Cycle

Subscriptions are billed in advance on a monthly or annual basis. Your subscription automatically renews at the end of each billing cycle unless you cancel before the renewal date.

7.4 Price Changes

We may change our prices with 30 days' advance notice. Price changes will take effect at the start of your next billing cycle after the notice period.

7.5 Refunds

Subscription fees are generally non-refundable. However:

  • Annual Plans: You may request a pro-rated refund within 14 days of initial purchase if you haven't extensively used the Service
  • Monthly Plans: No refunds for partial months
  • Service Issues: We may offer credits or refunds at our discretion for significant service disruptions

7.6 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation:

  • You retain access until the end of your current billing period
  • Your account will be downgraded to the free tier
  • Websites may be unpublished if they exceed free tier limits
  • No refund is issued for the remaining period

7.7 Failed Payments

If payment fails, we will attempt to charge your payment method again. After multiple failed attempts, your account may be downgraded or suspended until payment is resolved.

8. Custom Domains

You may connect custom domains to your websites. You are responsible for:

  • Domain registration and renewal fees (paid to your registrar)
  • Configuring DNS settings correctly
  • Ensuring you have the right to use the domain
  • Complying with domain registration policies

We provide SSL certificates for connected domains at no additional cost.

9. Third-Party Services

The Service may integrate with or link to third-party services (payment processors, analytics, social media, etc.). These services have their own terms and privacy policies. We are not responsible for:

  • The availability or functionality of third-party services
  • Content or practices of third-party services
  • Any loss or damage from using third-party services

Your use of third-party services is at your own risk.

10. Service Availability

10.1 Uptime

We strive to maintain high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we aim to provide advance notice)
  • Unplanned outages or technical issues
  • Factors beyond our control (internet outages, DDoS attacks, etc.)

10.2 Support

We provide customer support via email. Response times vary based on your subscription plan and issue severity. We do not guarantee specific response times.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, reliability, or completeness of content
  • Uninterrupted, secure, or error-free operation
  • Results or outcomes from using the Service

AI-generated content may contain errors, inaccuracies, or inappropriate material. You use the Service at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PAGESMITH SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or business opportunities
  • Cost of substitute services
  • Damages arising from your content or use of the Service

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Pagesmith, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

  • Your use of the Service
  • Your Content or websites
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your violation of applicable laws

14. Copyright and DMCA

We respect intellectual property rights. If you believe content on the Service infringes your copyright, please send a notice to [email protected] including:

  • Description of the copyrighted work
  • Location of the infringing content (URL)
  • Your contact information
  • A statement that you have a good faith belief the use is unauthorized
  • A statement under penalty of perjury that the information is accurate
  • Your physical or electronic signature

We may remove or disable access to allegedly infringing content and may terminate accounts of repeat infringers.

15. Termination

15.1 By You

You may stop using the Service and delete your account at any time from your account settings.

15.2 By Us

We may suspend or terminate your account if you:

  • Violate these Terms or our policies
  • Engage in fraudulent or illegal activities
  • Fail to pay applicable fees
  • Create risk or legal exposure for us

We will provide notice before termination when reasonably possible, except in cases of severe violations.

15.3 Effect of Termination

Upon termination:

  • Your right to use the Service immediately ceases
  • Your websites will be unpublished
  • Your data will be deleted according to our Privacy Policy
  • Provisions that should survive termination will remain in effect

16. Force Majeure

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, terrorism, riots, pandemics, government actions, internet outages, or other force majeure events.

17. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by:

  • Posting updated Terms with a new "Last updated" date
  • Sending an email notification
  • Displaying a notice in the Service

Continued use of the Service after changes constitutes acceptance. If you disagree with changes, you must stop using the Service.

18. Governing Law and Disputes

These Terms are governed by the laws of Finland, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of Helsinki, Finland. However, if you are a consumer in the EU, you may also bring proceedings in your country of residence.

For EU consumers: You may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

19. General Provisions

19.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Pagesmith.

19.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

19.3 Waiver

Our failure to enforce any right or provision shall not constitute a waiver of such right or provision.

19.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

19.5 No Agency

Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship between you and Pagesmith.
